Conditions of participation for the Pocket Advent Calendar 2023

1. Organizer

Pocket App AG, Industriestrasse 33, CH-5242 Lupfig (hereinafter referred to as "Pocket").

Any natural person who is at least 18 years old is eligible to participate. Participants who are minors must have the consent of their legal guardians to participate. The existence of such consent can be verified by Pocket. Excluded from participation are organs and employees of Pocket, their families, as well as all persons who are professionally in contact with this competition.

No purchase of Pocket goods/services is required to enter, but a valid Twitter/X or Instagram account, as well as Internet access, is required. Pocket does not use this competition to advertise financial products and does not offer any advice or other services outside Switzerland.

By entering the sweepstake, the person entering confirms that they agree to these terms and conditions.

4. Participation

To enter, the participating person must log in with their Twitter/X or Instagram account (or create a new one for free), go to Pocket's Twitter/X or Instagram profile page, follow that page and and reply with the correct answer to the daily quiz question in the comments.

A maximum of one entry per participating person per day is allowed during the contest period. Any additional entries / mails from the same person will not be considered in the draw (only the first entry / receipt counts).

In order to be valid and considered in the sweepstake, all entries must be made on Twitter/X or Instagram by the end of the daily contest period, everyday at 10 PM. Pocket is not responsible for failure to accept entries as a result of technical failures or other malfunctions.

If the person entering no longer wishes to participate in the sweepstake, they may notify Pocket at the email address team@pocketbitcoin.com.

5. Review

Pocket will reject entries that:

  • Are deemed objectionable, e.g., blasphemy, or could negatively impact the name, reputation, or goodwill of Pocket or a brand partner;
  • involve trademarks, logos or copyrighted material not owned by the participating person or used without the prior written consent of the rights holder (including famous names, company names, etc.);
  • disparage, misrepresent or insult any other person or entity, including but not limited to Pocket (and our affiliates);
  • Promote any political views.

6. Winner Determination

From among all valid entries, the entries with the correct answer or in case of estimation questions the closest answers to the correct one are selected and the lot decides the winner/s from this selection.

7. Notification and confirmation of the winners

The winner/s will be contacted via a private message via Pocket's Twitter/X or Instagram page on the day after the sweepstakes. Winner/s must respond within 1 days of initial contact to accept the prize. If a winner does not respond within 2 days of initial contact, Pocket reserves the right to disqualify that winner. The prize may be awarded to another person to be determined as described above.

Winners of Satoshis: The prize will be sent to the winners digitally via a Lightning Withdrawal link. The winners will receive a link to collect the prize and transfer it to a personal Lightning wallet. The link is valid for two weeks. The winners themselves are responsible for collecting the prize via the link.

Winners of vouchers for merchandise: The winners will receive the voucher code by private message and must redeem the prize themselves at Satoshistore.io.

Winners of physical merchandise: Winners must provide a delivery address. The prizes will be sent to the winners by post.

Winners of 0% fees on Bitcoin purchases: The winner must provide their name and email address in order to receive the fee discount.

8. Notes on the use of personal data

The data collected as part of participation in the competition (e.g. first and last name, address) will be collected, processed and used by Pocket for the purpose of carrying out the competition, including the delivery of the prize.

In addition, each participating person agrees with their participation that their personal data, such as first and last name, address, etc. can be used by Pocket for statistical and promotional purposes. Pocket may also pass on this data to service providers for the purpose of processing the competition, who take over tasks in whole or in part for the purpose of processing (e.g. transport companies for the delivery of prizes, organizational processing of event participation). The obligation of these service providers is analogous to the provisions of data protection law.

By participating in the competition, the participating person also grants Pocket the non-exclusive, territorially unrestricted right of use to reproduce, publish and make available the entry on the website and on Pocket's social media platforms without remuneration, even after the end of the competition. Pocket undertakes to carefully manage the personal data obtained in connection with the implementation of the sweepstakes.

Data that is transmitted via Twitter/X or Instagram or passed on to transport or partner companies, e.g. in the case of prize deliveries, is subject to their data protection regulations.

9. Data protection

The protection of the data of all participants is very important to Pocket. Insofar as Pocket collects, processes or uses personal data of participants in the course of its activities, this is done exclusively in accordance with data protection regulations. Participants can find further information on the handling of personal data in the privacy policy.

10. Exclusion from the competition, premature termination, liability

Pocket reserves the right to disqualify participants who manipulate or attempt to manipulate the competition and/or violate the conditions of participation or morality and/or otherwise attempt to influence the competition in an unfair manner without stating reasons and to exclude them from the competition without notice or to deny them their winnings and, if applicable, to reclaim them.

Pocket reserves the right to cancel or prematurely terminate the competition at any time without prior notice and without giving reasons. This applies in particular if proper execution cannot be guaranteed for technical or legal reasons. In such a case, the participants are not entitled to any claims against Pocket.

This competition is in no way sponsored, endorsed or administered by or in association with Twitter/X or Instagram. Entrants provide their information to Pocket and Twitter/X, Nostr or Instagram, assumes no liability for any component of this sweepstake.

Pocket will not be liable to the winner for any loss or damage of any kind incurred as a result of or in connection with the sweepstakes, data processing and the prize.

11. Legal basis

Swiss law is applicable to the competition.

The legal process is excluded.
